The first Sports & Entertainment Law Society meeting of the year will feature the first in a year-long series of presentations by Duke Law alumni on their careers in the fields of sports or entertainment. Kevin Cuddy (L’00), a sports attorney at Ropes & Gray, will discuss and take questions regarding his career path to sports law, as well as his area of emphasis, college athletics. Information will also be provided on various events and programs that SELS will be holding over the course of the upcoming year, and on how students can get more involved in the organization.

Professor Jeffrey Standen of the Willamette School of Law will present his recent law review article, "The Beauty of Bets: Wagers as Compensation for Professional Athletes”.  Professor Richman will discuss the economics effects of Professor Standen's proposal, and Professor Haagen will moderate the discussion.  Professor Standen’s article outlines the advantages of allowing athletes to bet on their games.

A panel including Duke Law Prof. Erwin Chemerinsky, Reporters Committee for Freedom of the Press Executive Director Lucy Dalglish, Vinson & Elkins media litigator Thomas Leatherbury and Los Angeles Times legal affairs reporter Henry Weinstein will discuss recent developments in law affecting the news media, including such high profile cases as the jailing of former New York Times reporter Judith Miller and sentences given to two San Francisco Chronicle reporters for refusing to testify in the BALCO steroids case. Prior restraints, freedom of information and the recent intersection of criminal law and press coverage in other high profile cases will be covered by the panel, to be followed by Q&A. Join us for lunch and conversation with Manny Azenberg, a legendary Broadway producer with more than 65 Broadway productions to his name.  Mr. Azenberg will discuss his career and the unique facets of the entertainment business as they relate to the theater.  Since 1972, Mr. Azenberg has produced all of Neil Simon’s plays on Broadway, including The Sunshine Boys, Brighton Beach Memoirs, and Lost in Yonkers, which won 1991 Pulitzer Prize for Drama.  He was most recently represented on Broadway by Neil Simon’s The Odd Couple, starring Nathan Lane and Matthew Broderick.  His stage productions have earned a total of 134 Tony Award nominations and have won 41 Tony Awards.  He currently serves on the American Theatre Wing’s Tony Awards Administration Committee, and has taught a seminar at Duke University for the past eighteen years.

Government, Technology and Culture: From Janet Jackson to iPod and Beyond
An address by Mr. Reed Hundt, former Chairman of the FCC (1993-97)

As Chairman of the Federal Communications Commission (FCC) from 1993 to 1997, Mr. Hundt presided over the implementation of the Telecommunications Act of 1996 and helped negotiate the World Trade Organization Telecommunications Agreement. Under his administration, the FCC raised more than $12 billion for the U.S. Treasury through competition-creating spectrum auctions.  Mr. Hundt spoke on regulating culture in entertainment and the impact of technological advances in establishing administrative policy. More specifically, Mr. Hunt examined public media and public outrage, and how they relate to First Amendment rights.

Fans and Professional Athletes: The Pacers/Pistons Incident and Its implications for Professional Sports

David Feher, partner at Dewey Ballantine and Duke Law graduate, presented a talk on the ramifications of discipline in professional sports, particularly focusing on the November 19th altercation between the members of Indiana Pacers, the Detroit Pistons, and fans. Mr. Feher presented an alternative viewpoint on this incident, including a previously unseen video of the fight that offers a perspective unseen in the footage circulated by ESPN and subsequent replays in mainstream media.

"Labor Strife & Economics: The Present & Future of the National Hockey League" examined the ramifications of the National Hockey League’s lockout, and its larger impact on the league's future and profitability. The panel, moderated by Duke Law professor Paul Haagen, also incorporated broader labor issues in professional sports, and in particular, paralleled hockey's development with leagues such as the NFL, the NBA, and Major League Baseball.
