ACCOUNTING

Scope: Study of basic accounting principles and practices and their relationship to the law, as well as problems relating to financial disclosure and the accountant's financial responsibility.

ADMINISTRATIVE LAW

Level: 4

Scope: Covers the body of law created by administrative agencies in the form of rules, regulations, orders, and decisions to carry out regulatory obligations. To some extent, the study of this area encompasses a review of due process rights under the Constitution and judicial review as they relate to administrative decisions. This area has broad application in the areas of banking and environmental law, as well as other specialized fields, that are highly regulatory in nature.

The topic of regulated industries involve the study of government economic regulation and deregulation in areas such as transportation, electric power, telephone, broadcasting, oil and gas, and health care. Emphasis on control of entry, mergers, rates, and interface between regulation and antitrust laws.

AIR AND SPACE LAW

Level: 4

Scope: Governs the use of airspace and its benefits for aviation, the public, and the world. Also known under the older term, Aviation Law.

ALTERNATIVE DISPUTE RESOLUTION

Level: 4

Scope: Includes negotiation, arbitration, mediation and other alternatives to litigation.

The negotiation and mediation course which is taught in multiple sections has one of the highest enrollments of any course.

Additionally, the Law School is home to the Private Adjudication Center. There is also a center for Dispute Resolution directed by Professor McGovern.


ANTITRUST AND TRADE REGULATION

Level: 4

Scope: The study of both federal and state statutes that proscribe unlawful restraint on trade and commerce, including in addition to the statutory study and case interpretation, the actions taken by the Federal Trade Commission

BANKING, FINANCIAL, AND INVESTMENT LAW

Level: 3

Scope: Covers federal and state regulations that govern banks and their business. Regulations exist at both the federal and state Level and cover traditional of notions commercial and investment banking as well as savings and loan associations and thrift institutions. As the area of banking is highly regulatory, an understanding of administrative law is also helpful.

BANKRUPTCY

Level: 4

Scope: Study of the rights and obligations between debtors and creditors and the resolution of conflicts between them, including discharge or exemptions of those obligations. In addition, the process of liquidation or rehabilitation and reorganization under the Bankruptcy Reform Act is explored. The role of an attorney, their duties and right to compensation in a bankruptcy action are also important to the student studying this area of law.

BIOTECHNOLOGY

Level: 3

Scope: The application to industry of advances made in the techniques and instruments of research in the biological sciences. Linked to the development of genetic engineering in the 70's. In 1980, the Supreme Court decided that a live human-made microorganism may be patented. This area covers intellectual property and medical applications.

BUSINESS ASSOCIATIONS

Scope: Examines the state and federal laws pertinent to corporations, and, to a lesser extent, partnerships as business entities. Covers the organization, financial structure, governance and dissolution, as well as relevant portions of federal securities law impacting on the corporation, such as federal regulation of the proxy system, tender offers and federal restraints on inside trading.

Covers both business organizations, such as agency and partnership, other forms of association, fiduciary obligation, and corporate law.

CIVIL PROCEDURE

Level: 4

Scope: Covers methods, procedures, and practices used in civil litigation. Each state has its own civil procedure code while federal court procedures are set out in Title 28 of the United States Code (the Federal Rules of Procedure). This is primarily a procedural area of law that provides rules regarding motions, discovery, appropriate venue and jurisdiction, alternative dispute mechanisms, as well as other procedures necessary to maintain the smooth operation of civil litigaiton.

Scope Civil rights are guaranteed to U.S. citizens by the Constitution (freedom of the press, speech, religion, etc.) and by statutory mandate, the most important of which is the Civil Rights of 1964, as amended, that addresses principles of equality particularly in area of employment law.

COMMERCIAL LAW

Scope: Commercial law covers the area of jurisprudence that regulates trade, commerce, and mercantile pursuits. It is primarily a codified area of law that is governed at the state Level. Most states base their commercial code on the Uniform Commercial Code published by the National Conference of Commissioners on Uniform State Laws and the American Law Institute. Within the scope of commercial transactions are the sale and leasing of goods, transfer of funds, commercial paper, bank deposits and collections, letters of credit, bulk transfers, warehouse receipts, investment securities and secured transactions.

CONFLICTS OF LAWS

Scope: Conflict of law rules address a sovereign's judicial competence on obligations that arise within the territory of two jurisdictions. It can be said to be a branch of jurisprudence that is derived from the diversity of laws of different nations or states and either the reconciliation of the rights and remedies granted by such jurisdictions, or the determination of which legal system would most appropriately apply.

CONSTITUTIONAL LAW

Scope: Constitutional law is that branch of public law that studies the powers and limitations of the government. This area of law examines issues such as the separation of powers; rights of individuals; balance between the federal and state government authorities; jurisdiction; and judicial review. Additionally, a historical overview of Constitutional interpretation through case law and legislative history is reviewed.

This is a subject that "falls between the cracks" at Duke. Perkins library does not collect much in this area. NCCU has a criminal justice program and does have some materials.

Death Penalty Litigation Clinic-gives students the opportunity to work on capital post-conviction cases either under the supervision of an attorney instructor or with attorneys in the community.

ENERGY LAW

Scope: The study of natural resources includes an examination of the legal rules that govern development of privately owned mineral rights. This area of law in some ways mirrors that of property law in that it entails a discussion of the creation of interests in mineral rights and leasing arrangements. It also includes a detailed examination of contract clauses that are particular to these types of leases: royalties, protection and development of the minerals, conveyance of mineral rights, and taxation of oil and gas interests and transactions.

ENVIRONMENTAL LAW


Level: 4

Scope: The area of law represents an examination of current environmental and administrative policies and statutory interpretation by the agencies and courts. Since most environmental litigation arises from agency disputes, a grounding of administrative law is important and is briefly reviewed in this area. Applicable federal statutes are also studied, focusing on the Administrative Procedures Act and the National Environmental Policy Act. The principle agency responsible for effecting national environmental policy is that Environmental Protection Agency; thus a discussion of how that agency is structured and its posture on specific environmental issues is usually warranted.

FAMILY LAW

Scope: Also known as domestic relations. This area of law is very broad in scope and can include traditional notions of family law (such as marital relations and divorce) to more specifically highlighted areas (such as in vitro fertilization and adoption). Generally speaking, family law covers all aspects of the marital relationship: marriages requirement, property rights in marriage, antenuptial agreements, unmarried cohabitation, divorce procedures and settlements. It also covers the relationship between parents and children. This includes adoption procedures and requirements, rights to in vitro fertilization, fetal and child custody rights, respect by the courts of parental authority, child abuse and child support, for parents and the state.

INSURANCE LAW

Scope: The study of insurance begins by defining what constitutes insurance. It also covers the ability of insurance companies to market and enter into contracts with individuals or companies. This breaks down into the various types of insurance policies, their interest and premium rates and the concept of risk based insurance. Finally, the procedures for presenting claims and processing settlements is reviewed. Throughout the study of this area regulatory measures, an abundant amount of case law and policies that play into insurance law are examined.

INTELLECTUAL PROPERTY

Scope: Intellectual property covers a wide array of areas, from art work, such as movies to industrial design to computer software programs. It covers copyright, patent and trademark law and the procedures for complying with each. Both statutory regulations and case law, as well as agency decisions, are discussed in relation to each area. LABOR RELATIONS AND EMPLOYMENT LAW

Scope: This area of law entails the study of labor-management relationships, the obligations owed to each other under federal law, protection of individual rights and the settlement process for dispute resolution that is unique to labor contracts. The study of labor law encompasses a review of the historical events that led to the creation of the present day system of labor relations, including the role and establishment of labor unions. Principal federal statutes are discussed and applied, such as the National Labor Relations Act and Title VII of the Civil Rights Act of 1964, as amended. In addition the establishment and enforcement of the collective bargaining agreement is reviewed, particularly in relation in individual rights under such agreements. Finally, methods of enforcing individual rights and settling workers' disputes are examined.

The study of property law entails common law and statutory land interests (such as life-estates, fee simple, etc.), future interests, conveyances of real property, landlord-tenant relationship, easements and recording the ownership of land in various types of title systems. It also includes personal property, community property, and historic preservation law.

Scope: Includes serving indigents, pro bono aspects, and people with disabilities as well.

Course is offered in poverty law requiring students to work at least 20 hours with attorneys representing low income people with legal problems and to interview clients in a Legal Services program.

SECURITIES


Level: 4

Scope: Legal aspects only. Discusses the significant securities legislation, mainly the Securities Act of 1933 and Securities Act of 1934. There is a review of disclosure requirements and regulation over the sale of the securities and the people who sell the securities. Additionally, concepts of securities fraud are introduced and methods of enforcement are looked at.

SPORTS LAW

Scope: Includes various aspects of sports law, including contracts, labor negotiations, and estate planning, and antitrust. This area is very interdependent on other subjects.

TAXATION


Level: 4

Scope: Taxation reviews the underlying principles of the federal tax code and its application to practical situations. It covers individual taxation, corporate taxation, not-for-profit taxation and international taxation. The study of taxation entails not only the statutory review of the Internal Revenue Code but agency and judicial decisions interpreting the Code. With respect to international taxation, the taxation of aliens and foreign corporations in the US and of US citizens and corporations abroad are analyzed.

Scope: This area of law covers civil wrongs including intentional torts, personal injury, defamation, negligence, and products liability among others.
