Nick Herman

Nick Herman received his Bachelor of Arts degree from the University of North Carolina at Chapel Hill as a Morehead Scholar and his Juris Doctor degree from Duke University School of Law. He has
been an adjunct professor at North Carolina Central University Law School since 1987, and has also taught at UNC-CH Law School and at Campbell Law School. He variously teaches criminal procedure,
evidence, criminal law, remedies, trial practice, pretrial litigation practice (including client interviewing and counseling), appellate advocacy, statutory interpretation, mediation, negotiation,
alternative dispute resolution, law office practice and management, legal research and writing, and civil litigation clinic.
Nick is the author of three law books–on the law of evidence, plea bargaining, and legal counseling and negotiating. He is also the author of a history book on the Order of the Golden Fleece at the University of North Carolina at Chapel Hill, which is the highest honorary at that University and the first honor society for university leaders in the nation. He has otherwise written numerous articles on various topics in civil and criminal law, and he has been a presenter at many continuing legal education seminars.
Nick has practiced law in Chapel Hill, North Carolina since 1981 and was a partner in the firm of Coleman, Bernholz, Gledhill, Hargrave & Herman. In 1997, he joined the Brough Law Firm, which specializes in representing local governments in land use law, civil rights cases, employment law, general representation, and litigation and appeals. In that capacity he has represented numerous clients in state and federal trials and appeals involving challenges to quasi-judicial and legislative zoning decisions; claims brought under the civil rights statutes, first amendment, and other constitutional amendments; eminent domain proceedings, claims under the Federal Fair Housing Act and Americans with Disabilities Act; and complex inter-governmental litigation in disputes over infrastructure matters and water rights. In addition, he represents clients in a variety of other matters such as in real property and contract disputes, personal injury, and in criminal defense.
