Center for the Study of the Public Domain Arts Project Contest Official Rules
ALL SUBMITTED ENTRIES MUST BE LICENSED PURSUANT TO A CREATIVE COMMONS LICENSE. MUST BE OVER 18 YEARS OLD TO ENTER. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The Center for the Study of the Public Domain “Arts Project Contest” ("Contest") commences at 12:01 a.m. EST on April 2, 2004, and ends at 9:00 p.m. EST on November 1st, 2004. Contest is sponsored and run, as a public education activity, by the Center for the Study of the Public Domain at Duke Law School, Science Drive & Towerview, Durham NC 27708, (919) 613-7270 ("Sponsor").
(1) Eligibility: Contest is offered only to natural persons older than 18 years of age as of the date of entry. Employees, independent contractors, officers, and directors of Sponsor, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, and the immediate family members and persons living in the same household of such persons, are not eligible to participate in the Contest. Void where prohibited by law.
(2) How to Enter: Submit entry online with a completed Contest Entry Form in which you specify the URL from which your work can be downloaded. Entries may be any form of moving image, including but not limited to, video, animation, and text. Duration of entry cannot exceed 2 minutes. Both audio/visual and visual only entries are permitted. To be eligible electronic entries must be received by Sponsor by 9:00 p.m. EST, November 1, 2004. Entrant must be the sole author and copyright owner of entry, or entrant must have permission (via license or otherwise) to use or incorporate those entry portions authored or owned by third parties. Use of images and works in the public domain may be incorporated into entries. However, materials which infringe on the rights of any third party may not be used. Sponsor is not responsible for late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries. Incomplete or illegible entries are not eligible. All entries must be licensed under a Creative Commons License.
(3) Prizes: One (1) First Prize: First Prize Winner may choose either: an Apple® Power Mac® G5 Computer (Dual 2GHz PowerPC G5) (Approximate retail value ("ARV"): US$3000), or an
Alienware Roswell 4100 Performance Digital Video Editing System Single Processor - AMD Opteron 242 64-Bit 1GB DDR PC-3200 (ARV: US$3000). One (1) Second Prize: Sony® Handycam® Camcorder (Model DCR-PC120BT) (ARV: $1200). One (1) Third Prize: Apple® iPod™ 20GB Digital Music Player (ARV: US$400).
At Sponsor's expense, prizes shall be shipped via United Parcel Service to winner's resident mailing address on or around January 30, 2005 (prizes will not be delivered to P.O. Boxes). All prize expenses and/or services not specified are not included and are the sole responsibility of the winner. No alternative prize, cash equivalent, or other substitution is permitted except by Sponsor in the event of prize unavailability. Prize is nontransferable. All federal, provincial, state and/or local taxes are the sole responsibility of the winners.
(4) Winners: Winners will be determined by highest overall grading from all eligible entries received. A panel of judges (none of whom are employed by the Center for the Study of the Public Domain) will grade all eligible entries based on their excellence in communicating the relationships between music and intellectual property law, or documentary film and intellectual property law, their artistic quality and their technical merit. All grading decisions are final. Sponsor reserves the right to disqualify any entry which is, in the judging panel's discretion, inappropriate, offensive or demeaning to Sponsor's reputation or goodwill. Winners will be notified by e-mail, and/or phone by January 15th, 2005 and shall be required to complete an affidavit or declaration of eligibility/liability-publicity release which must be signed and returned so that it is received within 10 days of the date printed on the prize notification, or the next highest score entrant will be awarded the respective prize. Failure to comply may result in forfeiture of all rights to prize(s). Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners. If a prize or prize notification letter is returned as undeliverable, prize may be forfeited and an alternate winner will be awarded. Accepting and/or using prize constitutes permission (except where prohibited by law) to use winner's name, hometown (including state or province) and/or likeness for promotional purposes without further compensation.
(5) General Terms and Conditions: By participating, entrants agree that Sponsor, its shareholders, agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors are not responsible or liable for, and shall be released and held harmless from: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted; (iii) any printing or typographical errors in any materials associated with the Contest; (iv) any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest, acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Sponsor reserves the right, in its sole discretion, to suspend or cancel Contest at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Contest. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of North Carolina or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of North Carolina.
(6) Winners List/Official Rules: A copy of these official rules and a winners list may be obtained by sending an email request to wojciech@law.duke.edu, or by mail to Eileen Wojciechowski, Staff Assistant, Center for the Study of the Public Domain, Duke Law School, Science & Towerview, Durham, NC 27708. Requests for winners list must be received by March 1st, 2005.
